I wish to employ an American national on an ongoing work contract (CDI). The individual is currently in France as a 'young professional'. What do I need to do?

Answer : In the context of the 'young professionals' procedure, the foreign national has undertaken to leave the French territory at the end of his work contract. He will therefore need to return to the United States before envisaging employment with a new employer in France.

I wish to employ an Australian national who holds a 'holiday-work' visa. How should I proceed?

Answer : The foreign national must request a provisional work permit (APT) from the local unit of the foreign workforce department (SMOE) for their future place of work in France.

I would like to bring an IT engineer of Algerian nationality to France. What procedures do I need to follow?

Answer : Algerian nationals remain subjected to the Franco-Algerian agreement of 27 December 1968. You will need to draw up a work contract for him as an 'employee' or 'temporary worker' according to the duration of the contract and to submit the file to the competent unit of the foreign workforce department (SMOE) for the place of work.

I wish to recruit a foreign employee who has come to see me – what procedure do I need to follow?

Answer : You must check that they have the correct authorisation to work. This authorisation can take different forms. If the interested party does hold authorisation to work, you should send the Préfet a copy of the residence permit supplied by the interested party at least 2 working days before they are due to start work. The Préfet will send their reply within a timeframe of 2 working days. If no reply has been sent, this obligation is considered to have been met. There is no need for this formality if the employee has a long stay visa granting exemption from the request for a temporary residence permit. What documents should be produced in order to work in France?

Answer : The employer should complete and sign a Cerfa form adapted to their work authorisation request. For more information, consult the various corresponding sheets on the website.

Which Préfecture should I contact with regard to verifying the truthfulness of authorisation?

Answer :  The employer should contact the Préfet for the Département in which the individual will be employed or, in Paris, the Préfet de Police.

Is it possible to conduct the verification of authorisation procedure online?

Answer :  The request can be made through an email or through a signed, dated letter sent by registered post with confirmation of receipt. This includes the transmission of a copy of the document issued abroad.
